By purchasing a Service or Power Hour, you are agreeing to these Terms and Conditions.
General
The following terms and conditions apply between you (the Client) and The Living House Interiors Ltd when you purchase Services from us. These terms do not affect your statutory rights.
No contract will exist between you and The Living House Interiors Ltd until a confirmation email has been sent following receipt of payment.
As the Client, you must provide your postcode, phone number, email address, and name. You will also complete a questionnaire to help us understand your preferred design style, provide photos of your space, and share additional information about your room and project. Depending on the Service selected, you will also have a video call with your designer. Your designer will then provide recommendations for your space, along with a shoppable list of products.
You confirm that all details, measurements, photographs, and information you provide to The Living House Interiors Ltd are accurate, up to date, and complete.
By purchasing a Service, you agree it will be used for your own private or domestic use only and is not for resale.
You must be 18 or over to use this Service. If you are under 18, you may only do so with the agreement and supervision of a parent or guardian.
A video call to commence your project must be booked within one year of the purchase date. After this period, you will be subject to any price increases that may have occurred during that time.
Project timelines are dependent on timely receipt of information, measurements, approvals, photographs, and feedback from the Client. Delays in providing these may affect delivery times.
Any timelines provided are estimates only and are not guaranteed.
The Living House Interiors Ltd reserves the right to refuse or decline a project at our discretion.
The Living House Interiors Ltd reserves the right to change the prices of any Service at any time.
The Living House Interiors Ltd does not accept liability (except as set out below) for any errors or omissions on our website, and reserves the right to change information, prices, specifications, and descriptions of any listed Services without notice.
If an error is found in the price of a Service you have ordered, we will inform you promptly. We are not obliged to fulfil an order for a Service advertised at an incorrect price.
Our business hours are Monday to Friday, excluding public holidays. We aim to respond to emails within two business days.
Payment and Cancellation
Payment must be received in full by bank transfer before your project start date is confirmed and your designer begins work.
The Living House Interiors Ltd uses third-party providers to process payments for The Layout Fix and Digital Interior Guides. These providers accept payments by various credit and debit cards, as shown on the applicable payment screen.
The Living House Interiors Ltd reserves the right to end any agreement with you if payment is not made or if you are in breach of these terms and conditions.
Where you are a consumer purchasing Services online, you may have a legal right to cancel within 14 days under the Consumer Contracts Regulations 2013.
By booking a project start date within this 14-day period, you expressly request that The Living House Interiors Ltd begins providing the Services before the cancellation period ends.
If you cancel after work has begun, we may retain an amount proportionate to the work already completed.
Once the Services have been fully performed, your cancellation rights will end.
If you wish to cancel your Service, you must notify us in writing by email.
If you have purchased a Service and wish to change it, you must notify us by email within 24 hours of payment being made. After this point, changes cannot be guaranteed as work on your project may already have begun.
The Living House Interiors Ltd may offer a full or partial refund at our discretion. Please contact us at hello@thelivinghouse.co.uk to request one.
The Design
The Service applies only to the room(s), design service, and scope specifically confirmed at the time of booking. Additional rooms, layouts, sourcing, revisions, or design requests may require an additional fee.
Unless expressly agreed in writing, our Services do not include architectural services, structural advice, planning applications, planning permission advice, building regulations compliance, technical drawings, procurement management, project management, construction drawings, or on-site supervision.
The design provided by The Living House Interiors Ltd is based on the measurements and information supplied by you, the Client. We cannot guarantee the accuracy of floorplans, dimensions, layouts, or 2D renders, which are provided for illustration purposes only.
Furniture layouts are indicative only and do not constitute technical, architectural, or construction plans. The Client is responsible for verifying all dimensions, clearances, access requirements, and suitability before purchase, installation, or commencement of works.
Please check all measurements carefully before making any purchases, ordering furniture, or commencing any works, as we cannot be held responsible for errors arising from inaccurate information provided to us.
The design provided is a recommendation only. We will supply details of where to purchase items but cannot be held responsible for changes in price, stock availability, discontinued products, delivery times, or the accuracy of that information at the time of purchase.
Prices quoted within the design dossier are accurate at the time of preparation only and may change without notice.
Your design dossier may include links to third-party websites. You are responsible for deciding whether to access or use them. We do not endorse and are not responsible for any features, content, advertising, products, or other materials on third-party websites. You assume all risk and we disclaim all liability arising from your use of them.
Some product links may be affiliate links, meaning we may earn a commission if you make a purchase, at no additional cost to you.
The Living House Interiors Ltd may receive trade discounts, commissions, or affiliate income from certain suppliers and retailers. Unless otherwise agreed, these are retained by us and do not affect the price paid by the Client.
It is the Client’s responsibility to implement the design.
The Client is responsible for checking product suitability, dimensions, access requirements, installation requirements, landlord permissions, and compliance with any applicable safety standards before purchase or installation.
The Living House Interiors Ltd is not responsible for the Client’s orders placed with retailers, nor for any issues relating to manufacture, delivery, damages, defects, delays, or returns.
Images and descriptions on retailer websites are not always accurate. Colours, textures, finishes, and materials may vary from those shown online or in digital presentations, and product information may be incomplete or incorrect.
Colours, Finishes, and Visual Representations
All moodboards, renders, floorplans, visualisations, and digital presentations are intended for illustrative purposes only.
Colours, textures, finishes, materials, proportions, and lighting may appear differently depending on screen settings, printer settings, photography, lighting conditions, and product manufacturing variations.
The Living House Interiors Ltd cannot guarantee that colours or finishes shown in digital or printed materials will exactly match the final product in person.
We strongly recommend obtaining physical samples, swatches, and product specifications from suppliers before placing any orders or commencing any works.
Delivery charges are not included in the shopping list unless specifically stated.
The Living House Interiors Ltd shall not be liable for any delay in delivering Services where that delay is due to circumstances beyond our reasonable control, including but not limited to acts of God, war, flood, fire, labour disputes, strikes, riots, civil commotion, malicious damage, explosion, internet outages, technology failures, or governmental actions.
We do not offer bathroom sanitaryware design or kitchen redesign or planning. Bathroom and kitchen design Services cover styling items only.
Services do not include unrelated finishes or fixtures unless specifically agreed, for example paint finishes for woodwork, carpet underlay, light switches, electrical plans, plumbing layouts, or building regulation compliance.
Prices for wallpaper, fabric, flooring, and paint are per item only and are not an estimate of the total quantity required.
Any budget provided to us should not include the cost of works required, such as carpet fitting, decorating, electrical work, plumbing, installation, or construction works.
Design dossiers will be emailed within approximately four weeks of your video call unless otherwise agreed.
We aim to get the design right first time. The Service includes one round of reasonable refinements within the original agreed brief during the post-design support period. Additional revisions or changes outside the agreed scope may incur additional charges.
We are not responsible for the work, omissions, advice, or conduct of any third-party contractor, installer, decorator, electrician, carpenter, builder, or tradesperson engaged by the Client. The Client is responsible for ensuring all works comply with applicable laws, regulations, planning requirements, and building regulations.
Video calls and online consultations are delivered using third-party technology platforms. We are not responsible for interruptions, technical failures, internet connectivity issues, or platform outages beyond our reasonable control.
Respectful Communication
The Living House Interiors Ltd is committed to maintaining a professional and respectful working environment.
We reserve the right to suspend or terminate a project or refuse further Services where a Client behaves in a manner that is abusive, threatening, discriminatory, offensive, aggressive, or otherwise inappropriate towards any member of our team.
In such circumstances, we reserve the right to retain payment for any work already completed and to invoice for work undertaken up to the date of termination.
To the fullest extent permitted by applicable law, we disclaim all warranties of any kind, whether express or implied, in relation to our Services. This does not affect your statutory rights as a consumer.
Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud, fraudulent misrepresentation, or any other liability which cannot legally be excluded.
Subject to the above, our total liability arising out of or in connection with the Services shall not exceed the amount paid by the Client for the relevant Service.
We shall not be liable for any indirect, consequential, or unforeseeable losses, including loss of profit, loss of opportunity, or disappointment arising from the use of our Services.
Once the Design Dossier and any included refinement period have concluded, the agreement between The Living House Interiors Ltd and the Client shall be deemed complete.
Project files, renders, and design documents may be deleted after 12 months from project completion.
Intellectual Property
All intellectual property rights in our designs, concepts, drawings, renders, moodboards, presentations, layouts, and design dossiers remain the property of The Living House Interiors Ltd.
The Client is granted a non-transferable licence to use the design for personal residential use only.
The Client may not reproduce, distribute, share, modify, sell, publish, or use any part of the design for commercial purposes without prior written permission from The Living House Interiors Ltd.
Marketing and Advertising
Your design, photographs, renders, or project imagery may be featured on our website, portfolio, email marketing, and social media channels for marketing purposes unless you notify us in writing that you do not wish this to happen.
We will never publish your full address or personal identifying information alongside project imagery.
Where your design is used for marketing purposes, we may reference the retailers featured in your design unless you have requested otherwise.
Your Privacy
At The Living House Interiors Ltd we are committed to protecting your privacy and handling your personal data in accordance with applicable UK data protection legislation, including the UK GDPR and Data Protection Act 2018.
Information We Collect
Our online contact form and questionnaire collect your name, email address, telephone number, address details, photographs, room measurements, design preferences, lifestyle information, and details of the Service you require.
What This Data Is Used For
Your data enables us to:
Fulfil the Service you have requested
Contact you regarding your project
Maintain internal records
Improve our website and Services
Comply with legal obligations
Send occasional marketing communications where permitted
Our lawful basis for processing your data is the performance of our contract with you, our legitimate business interests, and where applicable, your consent.
